GENATA User Service Agreement

1General Provisions

1.1 This agreement is between the user (hereinafter referred to as "you") and GENATA Technology (Shenzhen) Co., Ltd. (hereinafter referred to as "GENATA Company") regarding the use of all equipment related services provided by GENATA Company. By using equipment from GENATA Company, you agree to accept all terms and conditions of this agreement.

1.2 GENATA Company has the right to modify this agreement in a timely manner based on updates to laws and regulations, business development, and other factors. The revised agreement will be announced on the official website of GENATA Company or in the update prompts related to the equipment. If you continue to use the device after the revised agreement is published, it means that you accept the revised agreement.

2Service Content

2.1 Equipment usage

2.1.1 GENATA Company provides you with a range of equipment designed to meet your needs in security monitoring, network communication, data processing, and other areas. You have the right to use the device normally according to its design purpose, but you are not allowed to make any illegal, unauthorized modifications, disassembly, or damage to the device.

2.1.2 GENATA Company will make every effort to ensure the performance and functionality of the equipment, but due to unforeseeable factors such as technical limitations and external environment, the equipment may have certain limitations. GENATA Company shall not be liable for any losses or damages caused by these limitations.

2.2 Software updates and support

2.2.1 In order to improve the performance, security, and functionality of the equipment, GENATA Company may provide software updates to the equipment from time to time. You are responsible for installing these updates in a timely manner to ensure the normal operation of the device.

2.2.2 GENATA Company will provide you with technical support related to device usage within a reasonable range. However, for problems caused by your own improper operation, third-party software or hardware conflicts, GENATA Company has the right to charge a certain service fee based on specific circumstances.

3User's Rights and Obligations

3.1 Rights

3.1.1 You have the right to use the equipment and related services of GENATA Company in accordance with the provisions of this agreement.

When encountering problems during the normal use of the device, you have the right to seek technical support and after-sales service from GENATA Company.

3.2 Obligations

3.2.1 You should properly keep the equipment to prevent it from being lost, stolen, or used by unauthorized personnel. If the equipment is lost or other situations occur, you should promptly notify GENATA Company. Any adverse consequences caused by failure to notify in a timely manner shall be borne by you.

3.2.2 You shall not use the equipment of GENATA Company to engage in any illegal activities, including but not limited to infringing on the intellectual property rights of others, disseminating illegal information, conducting network attacks, etc. If GENATA Company discovers that you have engaged in such behavior, it has the right to suspend or terminate your device usage rights and hold you legally responsible in accordance with the law.

3.2.3 You shall comply with all applicable laws and regulations, including but not limited to those related to privacy protection, network security, telecommunications management, etc., and shall not harm national interests, social public interests, or the legitimate rights and interests of others during the use of the device.

4Intellectual Property

4.1 GENATA Company owns all intellectual property rights related to the equipment and its associated software, including but not limited to patents, trademarks, copyrights, etc. You are not allowed to engage in any infringement of these intellectual property rights.

4.2 Without the written permission of GENATA Company, you are not allowed to reverse engineer, decompile or crack the software related to the device. Otherwise, it will constitute an infringement of GENATA Company's intellectual property rights, and GENATA Company will pursue your legal responsibility in accordance with the law.

5Equipment Warranty and Maintenance

5.1 Warranty Period and Scope

5.1.1 GENATA Company provides a limited warranty service for the equipment for a certain period of time (see the instruction manual for the warranty period). During the warranty period, GENATA Company will provide free repair or replacement of parts for any malfunctions caused by the quality of the equipment itself.

5.1.2 The following situations are not covered by the warranty: equipment damage caused by human factors (such as falling, water ingress, unauthorized disassembly, etc.), force majeure factors (such as natural disasters, wars, etc.), failure caused by the use of non GENATA original parts or unauthorized repair services.

5.2 Maintenance Process

5.2.1 When the equipment malfunctions and needs repair, you can contact GENATA Company through their official customer service channel (400-6060-339) and follow the instructions of the customer service personnel. You need to provide relevant information such as purchase receipts for the device.  

5.2.2 For equipment that needs to be returned to the factory for repair, you should send the equipment back to the designated location in the manner specified by GENATA Company. During the maintenance period, GENATA Company will take good care of your equipment, but will not be responsible for the loss or damage of data in the equipment. It is recommended that you backup important data yourself before returning the equipment.

6Disclaimer

6.1 GENATA Company will make every effort to ensure the quality of equipment and the stability of services, but shall not be liable for any direct or indirect losses or damages caused by equipment failures, software defects, network problems, force majeure, etc., including but not limited to data loss, business interruption, profit loss, personal injury, etc.

6.2 GENATA Company shall not be liable for any loss or damage caused by compatibility issues between your use of third-party software, services, or equipment and GENATA Company's equipment. You shall bear the risks and ensure compliance with all laws, regulations, and provisions of this agreement when using third-party related content.

7Termination of the Agreement

7.1 In the following circumstances, GENATA Company has the right to terminate this agreement and cease providing equipment related services to you

7.1.1 If you violate any terms and conditions of this agreement and fail to correct it within a reasonable period of time after receiving written notice from GENATA Company.

7.1.2 You engage in any illegal activities or actions that damage the interests and reputation of GENATA Company.

7.1.3 Due to legal and regulatory requirements or decisions of government regulatory authorities, GENATA Company must terminate its services.

Upon termination of the agreement, you shall immediately cease using the equipment of GENATA Company and return or dispose of the equipment in accordance with GENATA Company's requirements. GENATA Company has the right to remotely lock the equipment or take other necessary measures to protect its legitimate rights and interests. Meanwhile, the termination of the agreement shall not affect the rights and obligations of both parties that have already arisen prior to the termination of the agreement, including but not limited to warranty obligations, intellectual property protection, etc.

8Application of Law and Dispute Resolution

8.1 By providing facilities and/or services through GENATA Company, you agree that the implementation and/or provision of services shall be subject to the laws of the People's Republic of China, and you agree to be subject to the jurisdiction of the courts of the People's Republic of China.

8.2 If any disputes or controversies arise between you and GENATA Company, they should first be resolved through friendly negotiations; If the negotiation fails, you agree to submit the dispute or controversy to the people's court with jurisdiction in Bao'an District, Shenzhen, where this agreement is signed.

8.3 The headings of all clauses in this agreement are for convenience of reading only and do not have any actual meaning in themselves, and cannot serve as a basis for interpreting the meaning of this agreement.
